George F. Cicotte

Practice Focus

Mr. Cicotte advises and represents employers of all sizes on all issues relating to employee benefits, handling matters before federal regulatory agencies and in federal courts.

Employee benefits include retirement plans (such as pensions, 401(k) plans, ESOPs and multi-employer plans), welfare benefit plans (encompassing health benefits, cafeteria plans, severance pay and apprenticeship programs) and other benefit plans (including executive compensation, deferred compensation and governmental plans). Mr. Cicotte’s work involves diverse issues of taxation, fiduciary responsibility, prohibited transactions, labor relations and employment discrimination.

Mr. Cicotte regularly provides confidential legal advice, obtains informal guidance and formal rulings from the IRS and the U.S. Department of Labor, helps clients resolve operational problems, plans and executes complex transactions and works out employee benefit matters in mergers and acquisitions. He has also defended class actions under ERISA involving claims for benefits, breach of fiduciary duty and interference with protected rights.

Mr. Cicotte assists clients in negotiations and arbitration and represents clients during tax and labor audits. He designs, drafts and amends plan documents and summary plan descriptions.

Professional Activities

Mr. Cicotte has spoken throughout the country for groups such as the Western Pension and Benefits Conference, The Institute for Applied Management and Law, The Society for Human Resource Management, Lorman Education Services, the National Association of Insurance and Financial Advisors, The National Employer Conference and the Zero Alpha Group. He has authored and co-written several articles and publications including the employee benefits chapter of The Contingent Workforce, published by Law Journal Press.

Education


Mr. Cicotte received his B.A. degree from the University of Pennsylvania in 1989 and his law degree from Brigham Young University in 1995.
